Club by-Laws

Definitions

"Adults"

A person of twenty-one (21) years of age (or such other age limit as the Company may from time to time determine) and above.

“By-Laws”
These By-Laws and any amendment and addition thereto for the time being in force.

“Children”
Unmarried children below the age of twenty-one (21) years or such other age limit as the Company may from time to time determine.

“the Company”
Dalit Bay Golf & Country Club Berhad.

“the Club”
Dalit Bay Golf & Country Club.

“Club Facilities”
The golf course and such other facilities offered by the Club.

“Club Manager”
The person appointed by the Company responsible for the day to day administration of the Club by whatever designation provided.

“Management”
The person or persons for the time being charged with the management of the Club.

“Member”
A Golfing Term Member or an Honorary Member of the Club.

“Rules”
The rules and regulations governing the rights of the Club and the Members in relation to the use of the Club Facilities and any amendment and addition there to for the time being in force.

“Public Holidays”
National and Sabah State holidays, which are declared as public holidays.

“Weekend”
Saturdays and Sundays.

General

Except where the context otherwise requires, the following definitions apply throughout these By-Laws:

  • Members, their spouses, guests and visitors shall at all times conduct themselves with decorum and observe courtesy and rules of etiquette while in the Club premises. Littering is strictly prohibited.
  • The Company shall not be liable for any loss of or damage howsoever caused to any articles whatsoever brought upon the Club’s premises by a Member or a member of his family or guests or visitors.
  • The Company shall not be liable for any injury whatsoever and howsoever caused whilst in the Club to a Member or a member of his family, his guests or visitors or to any other person.
  • Members, their spouses, guests and visitors shall use the proper attire prescribed by the By-Laws when using the Club Facilities.
  • Persons under the age of 18 are not permitted to consume any alcohol whilst in the Club premises and are not allowed in the bars of the clubhouse.
  • No radios, transistors or other similar appliances and equipment shall be used in any part of the Club premises, golf courses or practice areas.
  • Fishing in any of the lakes or ponds at the Club premises or grounds is prohibited except as permitted by the Management.
  • Members, their spouses, children or guests or visitors shall park their cars in an orderly manner and in designated parking lots as directed. They shall not park their cars in reserved lots and shall not cause obstruction.
  • The Company does not accept any responsibility for any loss, damage or injury whatsoever and howsoever caused to any car, its occupants, or its contents whilst parked at the Club premises.
  • Any complaints and suggestions must be made in writing to the Club Manager or the Management of the Club.


Golf

Definition

The game of golf to be played at the Club shall be governed by the following definitions:

  • “RAGC” shall mean the Royal and Ancient Golf Club of St. Andrew’s, Scotland
  • “USGA” should mean the United States Golf Association.
  • Club Handicap” shall mean a Provisional Club Handicap or Official Club Handicap calculated in accordance with the USGA System and certified by the Manager (Golf) or such other persons so authorised by the Management.
  • “Golf Courses” shall mean the golf course and such other courses of the Club, when available for play.
  • “Visitors” shall mean any person who is not a Member or a Member’s guest or a guest of the Management.
  • “Manager (Golf)” shall mean the person appointed by the Management to be responsible for the administration of the golfing facilities of the Club.
  • “Recognised Club” shall mean such club recognised by its National Golf Association or such club that is recognised by the Club.


RAGC & USGA Rules

The rules of golf as approved by the RAGC and the Handicapping System of USGA together with these By-laws and any other local rules as the Management may prescribe from time to time, shall apply to all form of play of golf and to all Club competitions unless otherwise expressly laid down by the Management in a particular match or competition.

Identification

Members - All members are required to present an official and valid membership card upon request by the Management, starters, course marshals or such other authorised personnel.

Eligibility To Play

The game of golf to be played at the Club shall be governed by the following definitions:

  • Members, spouses, children of Members, guests and visitors must produce a valid Club Handicap or an official USGA Handicap or be in possession of a proficiency certificate issued by the Management before they can use the Golf Course subject to these By-laws.
  • Players who are in possession of a proficiency certificate issued by the Management or whose official Club or USGA Handicap is above 36 (men) and 40 (women) shall be allowed to play on the Golf Course on designated days and time as may be determined by the Management.
  • A child of a Member is allowed to play on designated days and time as may be determined by the Management provided he is in the company of the Member or the Member’s spouse. Notwithstanding the above the Management may refuse to permit a child of a Member to play on such days and at such times as may be determined by the Management.


Club Handicap

  • Proficiency Certificate - Any Member who does not have a Club-Handicap shall first have to apply for a proficiency certificate test. Upon being successful, the Member shall be issued a proficiency certificate by the Management.
  • Provisional Handicap - A Member in possession of proficiency certificate shall be entitled to apply for a provisional handicap test upon returning at least ten (10) 18-hole score cards.
  • Official Club Handicap - A Member with a provisional handicap shall be entitled to apply for an Official Club Handicap upon returning at least ten (10) 18-hole score cards or twenty (20) 9-hole score cards. The Official Club Handicap assigned shall be the same as the Member’s provisional handicap or adjusted as the case may be.
  • Proficiency Certificate and Handicap Test - Application for a proficiency certificate or provisional handicap test or official handicap test shall be made at the golf office. The test will be carried out by an authorised tester as and when convenient.
  • Members with more than one Club - Members who are also members of other Recognised Clubs shall be entitled to apply for an Official Club Handicap provided that they submit properly certified latest handicap and course rating from such other Recognised Clubs. Such certified scores shall become part of the Member’s scoring record at the Club.
  • Assignment of Official Handicaps - An Official Club Handicap shall be assigned to successful Members on completion of their official handicap test or on submission of their certified handicap and course rating from other Recognised Clubs. Such assigned Official Club Handicap shall remain in force unless and until they are revised based on subsequent scores returned.
  • The above By-Laws applies to the Member’s spouse and children.


Guests or Visitors

  • A Member may introduce such number of guests as shall be determined by the Management from time to time, to play golf at any of the Golf Courses, provided that only up to three (3) of the guests of the Member shall be eligible for the guest’s green fee rate as published for each day of play.
  • The Member must be present in person to sign in the guests, unless otherwise permitted by the Management. Except for weekend and Public Holidays and when play is regulated by a time sheet, it is not necessary for the Member to play golf with the guests on the same flight.
  • Children cannot introduce guest to play golf at any time.
  • All guests or visitors must pay green fees at the golf office before going onto the Golf Courses and no excuses will be entertained for not complying with this regulation. Green fees paid shall not be refunded.
  • The green fees payable shall be determined by the Management from time to time
  • Notwithstanding any of the By-Laws herein, the Management may from time to time permit guests or visitors to play on the Golf Course on such days and times and subject to such conditions as it may deem fit.


Course Control

  • No play shall commence:
    (a) from any teeing ground other than the 1st Tee and 10th Tee and the players shall play each hole thereafter in proper sequence;
    (b) prior to 7:00 am except as may be permitted by the Management;
    (c) prior to the player’s full particulars and handicap being first registered with the golf office or with the starter, where applicable.
  • The Member must be present in person to sign in the guests, unless otherwise permitted by the Management. Except for weekend and Public Holidays and when play is regulated by a time sheet, it is not necessary for the Member to play golf with the guests on the same flight.
  • Children cannot introduce guest to play golf at any time.

Bookings

  • All bookings are to be made at the golf office either in person or by telephone or fax. A Member shall be permitted to book only one (1) flight for each day of play unless otherwise authorised by the Management. Booking on behalf of other Members is not allowed.
  • When booking, Members are to provide their names and membership numbers and indicate the names of the other Members/guests in the flight. Should the names of the other players be unavailable at the time of booking, Members must provide the names no later than 12:00noon on the day following the booking, failing which the Management reserves the right to cancel the booking or include other Members in the flight without further reference to the Member who made the booking.
  • The Member who made the booking shall be solely responsible for the non-appearance of any of the players in the same flight.
  • Members who fail to report to the starter 10 minutes before the booked tee-time will be liable to such penalties as shall be imposed by the Management from time to time, unless cancellation is made twenty-four (24) hours before the tee-off time.
  • The Management reserves the right to allow other players to tee-off for bookings not taken up.
  • Children are not allowed to make bookings for golf unless otherwise authorised by the Management.
  • Corporate Bookings - The Management may at any time from time to time reserve the whole or any part of the Golf Course for such purposes.


Control Of Play

  • When time sheets are in force, a minimum of three (3) players is required in a flight. However if a flight is left with two (2) players and they are unable to get another person to join them, they may play at the end of the time sheet. One (1) ball play when time sheets are in force is strictly prohibited.
  • When control of play is not regulated by a time sheet the form of play at any course shall be ‘open’ and the rules of golf as approved by the RAGC and USGA - Section 1 on etiquette under ‘priority on the course’ shall apply. A single player has no standing and should give way to a match of any kind.
  • Each player can only play one (1) ball at any one time on the Golf Course proper.
  • Undue Delay/Slow Play -
    (a)Players searching for a ball should signal the players behind him to pass as soon as it becomes apparent that the ball will not be easily found after a search of not more than five (5) minutes. They should also not continue play until the players following them have passed and are out of range.
    (b)If the group ahead is slowing down the group behind with one clear hole then the group behind shall be allowed to pass and play through in the same manner as (a) above.
    (c)Players are expected to assist and co-operate with the Officials and Course Marshals in their attempts to expedite the play of any group of players.
  • Bad Weather -
    Play on the course shall be regulated by the use of siren signals to signify as follows:
    (a) A series of 10 second blasts - Discontinue Play
    (b) A series of 5 second blasts - Resume Play
    (c) One continuous blast of about 1 minute - Play abandoned In the event the siren is out of order the Management shall use such other signals, as they shall deem fit under the circumstances.
  • Registration of Play - All players must register at the golf centre. No player shall commence play prior to his particulars being registered with the starter.
  • Issue and Return of Score Cards - Score cards will be issued to each golfer. All score cards issued must be properly completed and signed by every golfer concerned and returned to the handicap boxes without delay upon completion of the round. All golfers are therefore reminded not to lose or throw away any such score cards regardless of the number of holes played for any reasons, including cancellation of play due to bad weather.


Competition

  • Club Competitions - Only Members with an Official Club Handicap shall be entitled to participate in any Club Competition or match. For Club Trophy events, Children may participate at the discretion of the Management. All competitions and matches shall be governed by the rules of golf mentioned in By-Law 2.2 above.
  • Members belonging to more than one Club - Members belonging to two (2) or more clubs and having different Handicaps at different clubs shall use the lowest Handicap when competing in any Club competition or match.


Buggies

  • No players shall be allowed to play at the Golf Course without buggies.
  • Two (2) players in the same flight are expected to share a buggy.
  • Buggies will be deployed at the prescribed rate.
  • No booking and choosing of buggies is allowed.
  • Buggy deployment will be in accordance to tee-off time.


Practice Range

  • Children below the age of eighteen (18) are not allowed on the practice range except for training and accompanied by the Resident Golf Pro or an Adult Member.
  • Children below the age of 18 may use the practice range only with permission of the Management.
  • Members must practice from the tee markers unless otherwise directed.
  • Members bringing guests to the practice range are responsible for the registration of their guests, practice range fees, purchase of golf balls and conduct of their guests.
  • Practice range balls are not allowed to be taken outside the practice range area.


Dress Code

  • Golfers are to dress appropriately, both in terms of acceptability and practicality.
  • Ladies - Skirts, long pants or shorts. The shorts and skirts should not be higher than six (6) inches above the kneecap and golf shirt must have collars. Golf shoes with soft spikes and socks complete the ensemble. Jeans, jogging shorts/tennis shorts/football shorts, T-shirts and tracksuits will not be allowed.
  • Men - Long pants or shorts. Shorts should not be higher than six (6) inches above the kneecap. All golf shirts must be with sleeves and collars. Only golf shoes with soft spikes and socks will be allowed. Jeans, jogging shorts/tennis shorts/football shorts, T-shirts and tracksuits will not be allowed.
  • The Management shall not allow any player to tee-off unless they are properly attired.


General

  • Players shall not cause any damage to any part of the Golf Course, putting greens by whatever means, such as moving in a manner as to drag his feet, or jumping on the greens.
  • All players shall ensure that they repair pitch marks, replace divots and rake bunkers at all times.
  • Golf ball should be removed from the hole on the green by hand and not with the putter.
  • Non-golfers are not allowed on the course except as permitted by the Management.
  • Members signing in guests are responsible for the conduct of their guests.
  • Members shall be held liable for any damage to greens, tee markers, distance markers, etc. caused by their guests.
  • All golfers are PROHIBITED from keeping any personal effect and valuables in their golf bags. The golf service attendants attending to him shall not be held responsible for any loss or damage.
  • Members shall submit all score cards duly checked and signed by the Player and Markers. Failure to do so shall cause the Member to be subject to such action by the Management as it deems fit and may result in withdrawal or suspension of such Member’s Club Handicap.
  • The Club does not accept any liability for any injury or damage whatsoever and howsoever caused that may be suffered by a golfer, weather a Member or not while on the Golf Course or at the practice range.
  • Members, spouses, children of Members, guests and visitors who are in breach of any of these By-Laws shall be referred to the Management of the Club.


Food & Beverage

General

  • Only food and beverage available on the menu shall be ordered and served.
  • Last orders shall be taken not later than half an hour before closing time.
  • All complaints should be made to the Food & Beverage Manager, Food & Beverage Executive or Food & Beverage Supervisor.
  • No food or beverage other than that served by the Club may be brought to any part of the Club premises.

Operating Hours
Operating hours of all outlets will be determined by the Management from time to time.


Security

Membership/Security Checks

  • Members must carry their membership cards at all times when visiting the Club.
  • The Security Manager, Security Supervisors, Security Guards or any staff authorised by the Management may request any person within the Club premises to produce his membership card for verification.
